THE URBAN LIST’S “MATSO’S BROOME BREWERY – SUMMER 2018” PROMOTION
TERMS AND CONDITIONS
Information on how to enter and the prize form part of these Terms and Conditions. Participation in Matso’s Broome Brewery – Summer 2018 promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.
The Promoter is The Urban List Pty Ltd ATF The Urban List Trust (ABN 56 349 266 482). The Sponsor is Matso’s Broome Brewery, c/o Gage Roads Brewing Co Limited, 14 Absolon Street, Palmyra, Western Australia 6157 (ABN 22 103 014 320).
The Promotion is open to all Australian residents aged 18+ and over.
Employees (and their immediate family and/or those living in the same household) of the Promoter, and its respective affiliates, subsidiaries, agencies and suppliers associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
How to Enter
The Promotion period commences at 4:00pm AEDT on Friday 26th October 2018 and ends at 11:59pm AEDT on Sunday 11th November 2018 (“Promotional Period”).
To enter, individuals must complete the following steps during the Promotional Period:
Complete the entry form as hosted on the Promoter’s website, www.theurbanlist.com;
Game of skill: In 50 words or less, how will Matso’s help you ‘escape the ordinary’ this Summer?
6. Incomplete or indecipherable entries will be deemed invalid.
Determining and Notifying the Winner
1. The judging will take place at the Melbourne office of the Promotor, Level 1, 66-68 Cubitt Street, Cremorne, Melbourne, 3021 at 2:00pm AEDT on Monday 12th November 2018.
One (1) entry will be selected for the Major Prize. The judge may select additional reserve entry, in case of an invalid entry or ineligible entrant.
The Promoter’s decision is final and not for negotiation.
The winner’s will be notified via e-mail, on Monday 12th November 2018. The winner’s must acknowledge acceptance of and claim their Prize by replying to this e-mail with details requested. This must be received by the Promoter no later than 12.00pm AEDT on Wednesday 14th November 2018.
If for any reason a winner does not acknowledge accept of and claim their Prize by 12.00pm AEDT on Wednesday 14th November 2018, the prize will be forfeited and another winner selected.
The Promoter will have no liability for a winner's failure to receive notices due to winner’s spam, junk email or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information.
The one (1) winner of the Prize, will receive:
Return economy airfares for two (2) people to Broome, Western Australia, from your closest capital city (either Perth, Melbourne, Sydney or Brisbane)
Valued up to $2,200.00 (please note – airline is not specified nor able to be requested by the winner.
5 night’s accommodation in Broome, twin share

Tour of Matso’s Broome Brewery and tasting paddle at the end of the tour. Taste their fresh Ginger Beer, Mango Beer and seasonal brews at the home of Matso’s

Broome Hovercraft Eco Adventure Tour for two (2) people. Marvel at a spectacular Broome sunset from a remote landing on the Roebuck Bay tidal flats, and discover dinosaur footprints at low tides.
Valued at $392.00
Full Day Horizontal Falls Seaplane Adventure for two (2) people, including jetboating through the Falls, sea plane flights over the King Sound, and a big foot 4WD experience through the Kimberley.

Prize terms and conditions:
The Prize must be booked prior to June 30th 2019 and used before 31st December 2019.
All Prize redemptions are subject to tour operator capacity and availability.
All prizes/packages must be taken as offered. The prize/package, or any unused portion of the prize/ package, is not transferable or exchangeable and cannot be redeemed as cash. The prize/package is not valid in conjunction with any other offer except as specified by The Urban List (“The Promoter”) and Matso’s Broome Brewery c/o Gage Roads Brewing Co Limited (“The Sponsor”).
It is a condition of accepting the prize that the winner warrants to The Urban List (“The Promoter”) and Matso’s Broome Brewery c/o Gage Roads Brewing Co Limited (“The Sponsor”) that they understand that any arrangement entered into in relation to the redemption of this prize does not create a relationship between the winner and The Promoter or Sponsor. This Prize cannot be exchanged for goods or cash, nor can it be sold to any other person, and is non-transferrable. Prizes or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash.
If a Prize (or part thereof) is unavailable at the time of the selection of the Prize winner, the Promoter will supply the winner with a similar prize of equivalent value (as determined by the Promoter).
All additional meals, beverages, tips or any other extras not stated in the Prize description are the sole responsibility of the winner.
The sponsor will work with the prize winners to provide the travel package of equal value to what has been described above, however where unforeseen circumstances prevent the exact prize package being provided, the Sponsor will work to provide an experience of the same value.
Accommodation will be provided at an accommodation partner of Matso’s Broome Brewery, such as Moonlight Bay Suites. Accommodation will be 4 stars.
All tours and activities are subject to availability during the preferred travel dates of the competition winners. Winners are recommended to check weather patterns and seasons before choosing the dates to travel to Broome; as seasons are very prevalent in the Kimberley region.
Broome Hovercraft Eco Adventure Tours operate based on tides and sunset dates, so availability and tour dates vary seasonally. There are several different types of tours available, which should be considered when checking dates for the winners’ travel.
Food, beverages, additional luggage allowances, spending money, travel insurance or any other travel expenses not explicitly detailed as part of the prize are NOT included.
The promoter or the Sponsor are not liable for any loss or damage of personal items, delays in travel, illnesses incurred throughout travel period or any additional unforeseen circumstances.
It is highly recommended that the winner and their guest consider taking out their own personal travel insurance to cover themselves, their belongings, and their situation before, during and after travel.
The winner and their guest understand that the prize pool is provided by tour operators and organisations that have no affiliation with The Promoter or The Sponsor. The winner and their guest will be subject to individual terms and conditions and participant disclaimers that relate to the individual activities undertaken in the redemption of the prize package. The winner and their guest must accept the individual terms, conditions and participant rules of each individual tour operator. No responsibility for tour operations or the experiences provided by third party operators can or will be accepted by The Promoter or The Sponsor.
Matso’s Broome Brewery c/o Gage Roads Brewing Co Limited (ABN 22 103 014 320) will be informed of the winning entry and the winner’s details.
Matso’s Broome Brewery c/o Gage Roads Brewing Co Limited (ABN 22 103 014 320) reserve the right to engage with the winner for content creation, at their discretion.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence).
The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If a winner of the Prize is under the age of 18 years, the Prize will be forfeited by that entrant, and the next best entry will be awarded.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.
By attending the Prize event, all winners and their guests give permission to the Promoter to document their image and use that documentation in promotional campaigns including but not limited to social media, email, editorial, advertorial, website content and additional video platforms.
As a condition of entering the Promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.
As a condition of accepting the Prize, each winner must sign any legal documentation in the form required by the Promoter, and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
Entrants agree to have their personal details including name, email address, mobile, postcode and state added to the Promoter’s and Sponsor’s database lists.
Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
All entries become the property of the Promoter.
The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au/publications/synopses/ds10syn.htm.
