THE URBAN LIST’S “101 COLLINS STREET LIGHT SHOW” PROMOTION

TERMS AND CONDITIONS

Information on how to enter and the prize form part of these Terms and Conditions.  Participation in 101 Collins Street Light Show promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.

The Promoter is The Urban List Pty Ltd ATF The Urban List Trust (ABN 56 349 266 482).

Eligibility

The Promotion is open to all Australian residents aged 18 and over.

Employees (and their immediate family and/or those living in the same household) of the Promoter, and its respective affiliates, subsidiaries, agencies and suppliers associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

How to Enter

The Promotion period commences at 10:00am AEST on Monday 29th October 2018  and ends at 12:00pm AEST on Wednesday 14th November 2018 (“Promotional Period”).

To enter, individuals must follow the 101 Collins Street Instagram account (@101collinsstreet) and comment on The Urban List Melbourne Instagram post in 101 characters or less why they love Melbourne.

Incomplete or indecipherable entries will be deemed invalid.

Determining and Notifying the Winner

The judging will take place at the Melbourne office of the Promotor, Level 1, 66-68 Cubitt Street, Cremorne, Melbourne, 3021 at 10:00am AEST on Thursday 15th November 2018.

The Promoter will select a winner via a digital randomiser.

One (1) entry will be selected for the Major Prize. The judge may select additional reserve entry, in case of an invalid entry or ineligible entrant.

The Promoter’s decision is final and no correspondence will be entered into.

The winner’s will be notified via Instagram direct message, on Thursday 15th November 2018. The winner’s must acknowledge acceptance of and claim their Prize by replying to this message with details requested. This must be received by the Promoter no later than 12.00pm AEST on Monday 19th November 2018.

If for any reason a winner does not acknowledge accept of and claim their Prize by 12.00pm AEST on Monday 19th November 2018, the Prize will be forfeited and another winner selected.

The Promoter will have no liability for a winner's failure to receive notices due to winner’s spam, junk email or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information.

The Prize

The one (1) winner of the Prize, will receive:

1 x $20,000 voucher for Flight Centre Travel Group (FCTG), to be used on 2 x return business class flights to any city.

In total the Prize is valued at $ 20,000 AUD

Prize terms and conditions:

Gift Cards are redeemable at participating FCTG retail stores located within Australia.
Unless otherwise stated on the Gift Card, Gift Cards are valid for use within 3 years from the date of issue.
 Gift Cards purchased from 4 April 2018 will be issued with a PIN number. In order for a Gift Card to be redeemed, the customer must provide the associated unique PIN number at time of redemption. If a PIN number cannot be provided, the Gift Card will not be able to be redeemed.
Gift Cards may only be applied up to the maximum value loaded onto the Gift Card which is unspent at the time of use. Where the cost of purchase exceeds the available balance of the Gift Card, the excess amount must be paid by another payment method.
Gift Cards are non-refundable.
Gift Cards may be redeemed in whole or part during the validity period. Where used in part, no change will be given. Any unused balance may be used against future purchases, but will not be refunded or credited when the Gift Card expires.
Gift Cards cannot be reloaded.
Gift Cards may not be redeemed or exchanged for cash, traveller’s cheques, cash passports or any other form of currency.
Gift Cards may not, without the prior written consent of FCTG, be resold or offered for resale at a premium (including via online auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a Gift Card is sold or used in breach of this condition, FCTG may in its absolute and sole discretion cancel or render invalid the Gift Card without a refund and the Gift Card holder may be refused redemption of the Gift Card. FCTG will take all reasonable steps to notify you of FCTG’s intention to cancel or render invalid a Gift Card within a reasonable time before cancelling or rendering invalid the Gift Card.
 FCTG may cancel or render invalid any Gift Card (including any available balance) which FCTG determines in its absolute and sole discretion was purchased at any time and in any way (including via online auction or other unauthorised resale sites) by fraudulent means. FCTG may cancel any bookings made using any fraudulent Gift Card which may include any non-refundable amounts. FCTG will not be responsible for any costs incurred by you if you purchase or attempt to redeem any fraudulent Gift Card. You acknowledge and agree that you will not be entitled to redeem any available balance on any fraudulent Gift Card and that FCTG will not be obliged to hold such balance on file for you or otherwise redeem or exchange that Gift Card.
 You are responsible for the use and security of your Gift Card and PIN number. Lost or stolen Gift Cards may not be replaced or refunded. Lost or stolen PIN numbers cannot be reissued or replaced. You are liable for all transactions on your Gift Card except those caused by fraud or negligence by FCTG or its employees.
Defaced, mutilated or altered Gift Cards may not be accepted, replaced or refunded.
Gift Cards may not be used for payment of credit or retailer accounts.
Personal information collected in relation to your Gift Card will be handled in accordance with FCTG’s Privacy Policy which is available at www.flightcentre.com.au or in store.
 The laws of Queensland, Australia apply to these terms and conditions and any disputes arising in relation to them.
Questions or problems relating to Gift Cards should be directed to FCTG’s Gift Cards Care Team on 1300 554 268. Complaints about purchases made with a Gift Card should be resolved directly with the store concerned.


All Prize redemptions are subject to availability.
This Prize cannot be exchanged for goods or cash, nor can it be sold to any other person, and is non-transferrable. Prizes or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash.
The winner is solely responsible for any and all travel expenses to and from the Prize experience.
All additional meals, beverages, tips or any other extras not stated in the Prize description are the sole responsibility of the winner.
If a Prize (or part thereof) is unavailable at the time of the selection of the Prize winner, the Promoter will supply the winner with a similar prize of equivalent value (as determined by the Promoter).

General

101 Collins Street will be informed of the winning entry and the winner’s details.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence).

The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

If a winner of the Prize is under the age of 18 years, the Prize will be forfeited by that entrant, and the next best entry will be awarded.

In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.

By attending the Prize event, all winners and their guests give permission to the Promoter to document their image and use that documentation in promotional campaigns including but not limited to social media, email, editorial, advertorial, website content and additional video platforms.

As a condition of entering the Promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

As a condition of accepting the Prize, each winner must sign any legal documentation in the form required by the Promoter, and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

Entrants agree to have their email address added to the Promoter’s email list.

Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use this information, and disclose this information to third parties, including but not limited to 101 Collins Street, for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct personal information to the Promoter. The Promoters Privacy Policy is available at https://www.theurbanlist.com/privacy

All entries become the property of the Promoter.

The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au/publications/synopses/ds10syn.htm.
