TERMS AND CONDITIONS

  1. Information on how to enter and the prize form part of these Terms and Conditions.  Participation in Win A Sneaky Week Away To Vanuatu On Board A Royal Caribbean Cruise promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.

  2. The Promotion is conducted by Urban List Pty Ltd ACN 142 505 897 as trustee for The Urban List Trust (ABN 56 349 266 482) (“Promoter”).

Eligibility

  1. The Promotion is open to all Australia and New Zealand residents aged 18 and over who enter in accordance with these Terms and Conditions.

  2. Employees (and their immediate family and/or those living in the same household) of the Promoter, and its related entities, affiliates, subsidiaries, agencies and suppliers associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

How to Enter

  1. The Promotion period commences at 4:00pm on Tuesday 11 July 2023 ends at 11:59 on Sunday 6 August 2023. (“Promotional Period”). 

  2. To enter, individuals must complete the entry form during the Promotional Period as hosted on the Promoter’s website, www.theurbanlist.com.

  3. There is no cost to enter the Promotion.

  4. The Promoter reserves the right to refuse any entries which contravene these Terms and Conditions, including any incomplete or indecipherable entries.

    Determining and Notifying the Winner
     

  5. Selection of the Winner will take place at the Sydney office of the Promoter, 8 Hill Street, Surry Hills, NSW, 2010 at 2:00pm AEST on 8 August 2023.

  6. This Promotion will run as a game of chance. All eligible entries shall be placed into the draw, with the Winner chosen by an online random number generator. 

  7. The Promoter’s determination of the Winner is final and no correspondence will be entered into.

  8. The Winner will be notified via email or phone call, on 8 August 2023. The Winner must acknowledge acceptance of and claim their Prize by replying to this email or phone call with details requested. This must be received by the Promoter no later than 15 August 2023. 

  9. If for any reason a Winner does not acknowledge, accept and claim their Prize by 15 August 2023, that Prize will be forfeited, and another Winner selected at 2pm AEST on 16 August 2023.

  10. The Promoter will have no liability for a Winner's failure to receive notices due to Winner’s spam, junk email or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information.

    The Prize

  11. The Winner of the Prize will receive a 7 Night South Pacific Cruise with Royal Carribbean.

  • This Prize includes a 7 Night South Pacific Cruise for two (2) guests (including at least one person aged 18 or over) in an Interior stateroom cabin, departing and ending in Brisbane, Queensland, for up to 7 nights onboard Quantum of the Seas between the dates 22 January 2024 - 29 January 2024. 

  • Total prize pool is valued at up to AUD$2,358 based on published price as at 27 June 2023. All prices stated are in Australian dollars, represent the recommended retail price (RRP), include GST and are to the best knowledge, information and belief of the Promoter correct at time of printing.

  1. Prize terms and conditions: 

 

  1. The cruise Prize is valid for two (2) guests, with at least one (1) guest 18 years of age or older. During the entire duration of a cruise Prize, a nominated parent / guardian must accompany any person under 18 years of age. Any additional passengers are subject to the prevailing standard fare for the selected cruise date at the time of making the booking. 

  2. Each prize value is based on the twin share Interior Stateroom grade cabin and any upgrades are unavailable. Prizes are not transferrable to any other ship, cruise or date than that which is specified.

  3. The Winner is solely responsible for determining who to share the Prize with. 

  4. The Winner and their travelling companion/s are responsible for all other expenses not listed above including but not limited to: any other travel or onboard costs/expenditure, pre or post cruise accommodation, spending money, meals (other than those specified), drinks (other than those specified), mini-bar, incidentals, laundry, room service, phone calls, gratuities, optional activities and excursions, freight, excess baggage, ground transport, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, service charges, passports, visas, travel insurance, and all transfers, including travel costs to and from their closest capital city airport if the Winner is from a regional area. The Winner is responsible for ensuring that they and their travelling companion are fit to travel and have received appropriate immunisations, insurance, and/or health checks prior to taking the prize.

  5. It is the Winner’s and their travelling companion’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas which meet the requirements of immigration and other government authorities at the destinations. Any fines, penalties, payments of expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller.

  6. Where relevant, it is the Winner’s and their travel companion’s personal responsibility to ensure that they have valid travel and health documentation. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Winner and their travel companions. The Promoter and the Prize Provider makes no representation as to the safety, conditions or other issues that may exist at any destination.

  7. All Prize travel will be subject to the carrier’s General Conditions of Carriage. The Promoters and carrier make no representations as to the safety, conditions or other issues that may exist at any destination. By entering this Competition, and by collecting the Prize, the Winner acknowledges and accepts that driving, travel and any other activities comprising the Prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses.

  8. The Promoter/Prize Provider strongly recommends that all Winner take out travel insurance and consult the www.smarttraveller.gov.au website prior to travelling.

  9. Prizes cannot be exchanged for goods or cash, nor can they be sold or otherwise transferred to any person. 

  10. Unless otherwise expressly stated, Prize values are based upon the recommended retail prices as at 27 June 2023. The Prize Provider accepts no responsibility for change in Prize value between now and the ultimate Prize redemption date.

  11. Independent financial advice should be sought as tax implications may arise as a result of accepting the Prize.

  12. All Entrants agree that if they Win the Prize, they will not, and their companions will not, sell or otherwise provide their story and / or photographs to any media or other organisation, including the internet. Photographs will be allowed only at the discretion of the Prize Provider.

  13. In the event that a prize, or part of a prize, is unavailable (for any reason beyond the Promoter's reasonable control), the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal or greater recommended retail value and/or specification, subject to any written directions from the various lottery departments.

  14. The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at https://www.nhmrc.gov.au/health-advice/alcohol and at DrinkWise at http://drinkwise.org.au/

  15. Participation in the Prize experience is open to participants of all ages and fitness levels. However, if a Winner has physical limitations or requires a carer, the Promoter must be notified, and any carers must accompany the participant. Winner agrees to sign any waiver reasonably required by the Promoter, Royal Caribbean or Luxury Escapes.

  16. The Winner acknowledge and accept that some prizes that form part of the prize pool are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may take place.

  17. It is a condition of accepting the prize that the Winner and their companions (if any) must comply with all the conditions of use of the prize and the prize supplier’s requirements (as applicable).

  18. Any attempt to deliberately damage or undermine the legitimate operation of this competition, may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the promoter reserves the right to seek damages to the fullest extent permitted by law.

  19. General

  1. The Promoter will inform  Royal Caribbean and Luxury Escape of entrants’ details who select ‘yes’ to the question on the entry form - ‘I agree to receive information from  Royal Caribbean and Luxury Escape. For clarity, if an entrant selects ‘yes’, the entrant will be subscribed to Royal Caribbean and Luxury Escapes. for online marketing and promotional communications. Entrants consent to their name and email address being used for this purpose.

  2. Without limiting the above, the Winner agrees to participate in all promotional activity (such as publicity and photography) in connection with the Promotion and/ or the winning of the Prize (as reasonably requested by Royal Caribbean and Luxury Escape), free of charge, and agree to sign any additional documents reasonably required by the Promoter and Royal Caribbean and Luxury Escapes to give effect to this condition. Subject to law, the Winner must consent to using their names, likeness, images and/or voices (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome) or undertaking the Prize.

  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence).

  4. The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  5. If a Winner of the Prize is under the age of 18 years, the Prize will be forfeited by that entrant, and a redraw will occur.

  6. In the event of war, terrorism, pandemic or epidemic, state of emergency, government restrictions or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize. The Promoter reserves the right to modify, suspend or terminate the Promotion without notice.

  7. As a condition of entering the Promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

  8. As a condition of accepting the Prize, the Winner must sign any legal documentation in the form required by the Promoter, and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

  9. Entrants agree to have their email address added to the Promoter’s email list.

  10. Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all claims, liability, loss or damage (including loss of opportunity) suffered or incurred by any person; whether direct, indirect, special or consequential, arising in any way out of the Promotion or acceptance of or use of any prize.

  11. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use this information, and disclose this information to third parties, including but not limited to Royal Caribbean and Luxury Escapes. for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.   12. All entries become the property of the Promoter. 

  13. The Promoter accepts no liability for any problems or technical malfunction of computer systems, servers, software, internet service provider or email systems, including failure of any entry to be received on account of technical problems, or the failure of a Winner to receive a notification due to such technical problems.

  14. This Promotion is void where prohibited or restricted by law.

  15. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

  16. If for any reason this Competition is not capable of running as planned, including (without limitation) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the reasonable control of the Promoter, the Promoter reserves the right in its sole discretion take any action that may be available, and (without limitation) to cancel, terminate, modify or suspend the competition, subject to any direction given under State or other applicable Regulation or Law.
