TERMS AND CONDITIONS

 

  1. Information on how to enter and the prize form part of these Terms and Conditions.  Participation in The Urban List x CinefestOz & Australia’s South West Tourism Ultimate VIP Experience to the Margaret River Promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.
     

  2. The Promoter is The Urban List Pty Ltd ATF The Urban List Trust (ABN 56 349 266 482).


Eligibility
 

  1. The Promotion is open to all Victorian residents aged 18 and over.
     

  2. Employees (and their immediate family and/or those living in the same household) of the Promoter, and its respective affiliates, subsidiaries, agencies and suppliers associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

  1. Rights for alcohol prizes will not be distributed by or to any person under 18, nor can a person under 18 dispense or collect an alcohol prize. Entrants will be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any relevant laws or codes including those relating to the responsible service of alcohol. The Promoter supports the responsible service of alcohol.


 

How to Enter

 

  1. The Promotion period commences at 9am AEST on Wednesday 3rd August 2022 ends at 11:59pm AEST Sunday 14th August 2022. (“Promotional Period”). 

 

  1. To enter, individuals must simply enter their full name, email, agree to share their information and receive marketing material from CinefestOZ & Australia’s South West Tourism agree to the terms and conditions.
     

  2. Incomplete or indecipherable entries will be deemed invalid.

    Determining and Notifying the Winner
     

  3. Selection of the winner(s) will take place at the Sydney office of the Promoter, 8 Hill Street, Surry Hills, NSW, 2010 on Monday 15th August 2022.

 

  1. This competition will run as a Game of Chance. The winner(s) will be decided at random electronic selection.

 

  1. The Promoter’s decision is final and no correspondence will be entered into.
     

  2. The winner(s) will be notified via email on Monday 15th August 2022. The winner must email mainsworth@theurbanlist.com to claim their prize.

 

  1. If for any reason a winner does not acknowledge, accept and claim their Prize by Wednesday 17th August 2022 the Prize will be forfeited and another winner selected.
     

  2. The Promoter will have no liability for a winner's failure to receive notices due to winner’s spam, junk email or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information.

  1. Prize terms and conditions: 

 

  • Prize is for the above inclusions only, and additional costs not limited to but including transportation, travel costs, food etc will need to be covered by the winner.

  • Anything not listed in the above prize details and value is not part of the prizing. 

  • Prizing cannot be negotiated or traded in for something else.

 

  • Flights are from Melbourne direct to Busselton-Margaret River, flying Jetstar

  • The flight dates are departing Melbourne on Monday 22 August and returning on Saturday 27 August

  • The winners must be available to fly during the allocated dates to attend CinfestOZ festival.

  • The Flights are NOT transferable to different dates.

  • Fare inclusions: Max Bundle, 7kg carry on baggage, 30kg checked in baggage, free seating reserved, change flight date or times (no change fee from JQ but fare differences will apply), in flight meal/snack, flexible fare, credit voucher option.

  • Extra fees may apply for any name changes, change of date bookings, additional luggage etc.

  • Please note should the prize winners decide to extend their stay, then the difference in fare cost and any associated costs will be invoiced to their account.

  • The winner will be required to provide car hire provider with a valid driver’s licence and credit card. Car insurance and excess reduction to be covered by the prize winner and is not included as part of this promotion.

  • Private Properties will require a valid credit card to hold a $1000 deposit as bond for the duration of the winner’s stay

  • The CinefestOZ & Australia’s South West Tourism VIP Prize Package includes:

  • Any promotional elements not taken during the redemption period (August 22 – August 27 2022) will be forfeited and not reimbursable for cash

  • Travel insurance is to be arranged at the winner’s discretion and is not included as part of this prize.

  • Collect vehicle 

  • Lunch and afternoon Brewery Tour at Shelter Busselton

  • Check into Private Property accom

 

TUESDAY 23 AUGUST

  • 9am – 5pm: Margaret River exposed tour

  • 5pm – Opening Night of 6 Festivals Margaret River

 

WEDNESDAY 24 AUGUST

  • 10:30am: EcoAdventures Margaret River tour

  • 5pm: Busselton Opening Night – Seriously Red on Wednesday 24 August

 

THURSDAY 25 AUGUST

  • Lunch: In Conversation: Seriously Red at Rustico at Hayshed Hill on Thursday 25 August

  • 5pm: Premiere Event: Of An Age MIFF@CinefestOZ on Thursday 25 August

 

FRIDAY 26 AUGUST

  • Friday morning Forester VIP Wine Tasting (bus transfer included)

  • Afternoon: SW Wanderer Pass tour 

  • (Suggested 2pm Busselton Whale Watching experience OR Busselton Jetty)

  • Premiere Event - Sweet As MIFF@CinefestOZ on Friday 26 August at 5.45pm

  • Premiere Event – Transfusion on Friday 26 August at 8.15pm

 

SATURDAY 27 AUGUST

  • Make a stop at Origins Market Busselton to spend your voucher, before heading to the Airport for your flight back to Melbourne

  • Drop car hire vehicle back to depot

  • Depart Busselton-Margaret River on JQ901 at 12:15pm, arriving Melbourne at 5:40pm


 

General
 

  1. Subject to law, the winner(s) must consent to using their names, likeness, images and/or voices (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), or undertaking the Prize.

 

  1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence).
     

  2. The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

  1. If a winner of the Prize is under the age of 18 years, the Prize will be forfeited by that entrant, and a redraw will occur.

 

  1. In the event of war, terrorism, state of emergency, disaster or Covid-19 the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize. The Promoter reserves the right to modify, suspend or terminate the Promotion without notice.

 

  1. By accepting the prize, the winner and their guests give permission to the Promoter to document their image and use that documentation in promotional campaigns including but not limited to social media, email, editorial, advertorial, website content and additional video platforms. 

 

  1. As a condition of entering the Promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

 

  1. As a condition of accepting the Prize, each winner must sign any legal documentation in the form required by the Promoter, and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

 

  1. Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

 

  1. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use this information, and disclose this information to third parties, including but not limited to CinefestOz and Australia’s South West Tourism for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.   1. The winner accepts that they will be responsible and financially liable for any damages made to the property during their stay.

 

  1. All entries become the property of the Promoter.
